Material and Workmanship: All material is guaranteed to be as specified unless changed or substituted by the Owner or Owner’s Representative. All work shall be executed in a workmanlike manner in accordance with accepted standard practices. Any alterations or deviations from the contract and specifications involving additional costs will be executed only upon written authorization from the Owner or Owner’s Representative and will incur extra charges.
Liability: We will not be held responsible for materials or labor subject to strikes, accidents, delays, or Acts of God. In any litigation, arbitration, or disputes relating to the Proposal, including change orders or modifications to plans and specifications, the prevailing party shall recover its attorney fees and related costs from the non-prevailing party.
Payment Terms: Credit/Debit Card - Visa, Mastercard, American Express, and Discover are accepted. Payments are subject to a 3.75% convenience fee, which is collected by the Credit/Debit Card Vendor and not retained by Aguila Electrical Services Inc. Payments not received according to the approved schedule shall be considered past due, and work will not proceed until all past due payments are current.
Plans and Specifications: Electrical work requested by others and not indicated in the plans or specifications shall not be part of this agreement.
Change Orders: Deviation or alteration to the scope of this agreement, including plans or specifications, shall be executed upon receipt of written orders.
Design Errors: Modifications required due to design errors by the architect or engineer shall be considered change orders.
Equipment Supplied by Others: The electrical contractor is not responsible for the installation, damage, theft, vandalism, storage, or warranty of equipment supplied by others.
Codes and Installation Practices: Material and equipment supplied by the electrical contractor shall be installed in accordance with the National Electrical Code, local electrical building codes, and standard electrical practices. Requirements not codified as of the date of this proposal are excluded from this quotation.
Performance: The electrical contractor will not work after 5 PM or on weekends (overtime) unless authorized in writing by the Owner or contractor via a signed change order.
Permit: The cost of the permit shall be paid by the Owner.
Repairs: The electrical contractor shall not be responsible for repairs to concrete, drywall, including painting, patching, and ceiling or roof penetrations required for the installation of electrical wiring and equipment.
Asphalt Repairs: Asphalt repairs are not included. Any cutting, trenching, or damage to landscaping and asphalt is not included unless clearly stated by the electrical contractor.
Contract Expiration: Upon signature and approval, this contract is valid for up to 365 calendar days. After 365 days, the contract will become null and void.
